How is Child Support Calculated?

Historically, child support was a percentage of the non-custodial spouses income paid to the custodial parent. Since joint physical care has become more common, now we figure the child support obligation for each party. Whoever has the highest payment pays the other spouse less the payment amount the other spouse would have paid had they had higher income. This is something of a simplification but it gives you a general idea.

Iowa Courts favor protecting children above all. So our Judges are not likely to agree to a no-support arrangement.

Most Iowa attorneys use Iowa Child Support Master to calculate your child support.

When is Alimony awarded in Iowa?

Alimony is largely of relic of times when men were the "bread winners" and women stayed at home to rear the children. Today most couples both work so there is typically no alimony awarded.

But there are still three types of alimony awarded in Iowa; Traditional, Reimbursement and Rehabilitative.

Traditional Alimony- There are still at least a few traditional couples in Iowa where the wife has little education, has never worked, has few skills, it has been a long term marriage and the husband has a high income. In this case the husband (in theory it could be the wife, but good luck finding an actual example of this) may be ordered to pay traditional alimony which would end only when the recipient remarries or dies.

Reimbursement Alimony- applies when one spouse has sacrificed in a major way for the other. So maybe the wife was in medical school and the husband quit his good job to care for the kids. Now the wife just got her degree and big job and filed for divorce. Traditional alimony would be overkill since the husband can get back in to the workforce and make good money, but he deserves to be compensated for his temporary loss of income potential.

Rehabilitative Alimony- functions like Reimbursement Alimony, giving the payee spouse time to get back on their feet on income. Perhaps it will be awarded for one year, giving the recipient time to get a good job and then it will end.
